Terms of Service

These Terms of Service (Terms) are an agreement between you and Cuna Labs (Cuna, we, or us). They govern your access to getcuna.com, the Cuna console, cloud machines, and related services (together, the Service).

By creating an account, clicking a sign-in or continuation control presented with these Terms, or using the Service, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the Service.

If you use Cuna for an organization, you represent that you have authority to bind it, and you includes that organization.

You must be at least 18 years old and legally able to enter this agreement. If the age of legal majority where you live is higher, you must have reached that age. The Service is intended for professional and business use, not for children.

Provide accurate account information, protect your sign-in methods, and notify us promptly if you suspect unauthorized access. You are responsible for activity through your account except to the extent it was caused by Cuna's breach of these Terms or applicable law. Do not sell, transfer, or provide unauthorized access to an account or workspace.

Cuna provides a web console for running AI coding agents on isolated cloud machines and for viewing machine activity and estimated runtime or usage records. Provider balances and cost figures may be estimates, not billing statements. You may create, size, start, pause, stop, and delete machines as the available console permits.

Capacity is limited. We may place an account on a waitlist, require onboarding before console access, and limit the number or size of machines. We do not guarantee that a workspace or a particular agent will be immediately or continuously available.

The current Service is the web experience described in our documentation. Source repositories for preview SDK clients may be public, but Cuna does not currently offer a supported public API, GA SDK, Cuna CLI, or generally usable installable package. A bootstrap registry package is a namespace reservation, not a supported release. Statements about possible future features are plans, not commitments.

A mandateis a technical boundary for a task. It may describe repositories, files, permissions, duration, or usage. A mandate is not a separate legal contract and does not make an AI agent Cuna's legal agent, employee, representative, fiduciary, or professional adviser.

You must have authority to access, use, change, or direct every repository, account, file, system, service, and other resource involved in a task. You are responsible for the scope you grant and the instructions you provide.

AI systems are probabilistic. Agents may take unintended actions or produce inaccurate, incomplete, insecure, offensive, harmful, or infringing material. Similar or identical output may be generated for other users. Technical controls reduce risk; they do not guarantee a correct result.

Review, test, and validate agent actions and output before relying on or deploying them. Maintain appropriate backups and human approval procedures. Do not rely on Cuna or an agent as a substitute for legal, medical, financial, accounting, employment, safety, or other professional judgment.

You decide whether and how to use an output and are responsible for deployments, transactions, communications, or other consequences you authorize.

Your Content means instructions, source code, files, repository content, prompts, data, environment configuration, and other material you or your users provide to the Service.

As between you and Cuna, you retain your rights in Your Content. You grant Cuna a limited, non-exclusive, worldwide license to host, copy, transmit, process, and display Your Content only as needed to provide, secure, maintain, troubleshoot, and comply with law concerning the Service. You represent that you have the rights and permissions needed for that processing.

Add credentials only through a documented credential workflow. Cuna may receive and transmit a secret to its runtime provider to operate your machine; do not send secrets through support email, prompts, or another unsecured channel.

As between you and Cuna, and to the extent permitted by law, Cuna claims no ownership in output generated specifically for you from Your Content. This does not transfer rights in Cuna technology, third-party material, open-source software, models, or material owned by another person.

We do not represent that output is copyrightable, unique, or free of third-party rights. You are responsible for licenses and notices that apply to source code, dependencies, models, datasets, and other third-party material.

Cuna and its licensors retain all rights in the Service, interfaces, designs, documentation, trademarks, and related technology. If you voluntarily provide feedback, you allow us to use it without restriction or compensation. Feedback does not include Your Content or information you identify as confidential.

Cuna selects providers such as Supabase, Vercel, Fly.io, Runta, Calendly, and Resend to operate authentication, hosting, machines, scheduling, and email. Cuna remains responsible for its own obligations concerning those providers where applicable law requires it.

A source-control host, model provider, agent provider, or other service that you deliberately connect or license is governed by its own terms and privacy notice. We do not control its independent conduct or availability. You are responsible for maintaining the account, permission, and license needed for your task.

You may not use Cuna to:

• access or modify a system, account, repository, or data without the owner's authorization;
• distribute malware, steal credentials, exfiltrate data, phish, facilitate fraud, or disrupt a service;
• test security outside a clearly authorized scope or exceed that scope;
• violate law, sanctions, export controls, contracts, licenses, intellectual-property rights, privacy rights, or another person's rights;
• create or distribute child sexual abuse material, exploit another person, harass, threaten, impersonate, or unlawfully discriminate;
• make fully automated high-impact decisions about employment, housing, credit, insurance, education, healthcare, legal services, or essential services without required human review and legal safeguards;
• mine cryptocurrency, resell unauthorized compute access, evade limits, probe Cuna without permission, or interfere with another customer; or
• process sensitive regulated data unless Cuna has expressly agreed in writing and all required safeguards and data-processing terms are in place.

Good-faith security research is allowed only when you own the target or have written authorization and remain within that authorization.

Cuna may provide limited promotional access. References such as "about one month" or an estimated USD value describe the expected trial experience, not a guaranteed duration or cash credit. Access may end when included provider capacity or usage is exhausted, when the stated trial period ends, or when access is suspended under these Terms. Promotional access is personal, non-transferable, and has no cash value.

The current public trial does not automatically convert into a paid subscription, and Cuna does not charge a payment method when it ends. Any paid plan, renewal, usage charge, tax, cancellation rule, or refund term must be shown and separately accepted before a charge. A separate order or written agreement may include additional terms.

Our Privacy Policyexplains how Cuna handles personal information. If Your Content includes another person's information, you are responsible for a lawful basis, required notices and permissions, and honoring that person's rights.

Do not use Cuna to process regulated personal information on behalf of an organization until any legally required data processing agreement and safeguards are in place.

The Service is early-stage and provided without a service-level commitment unless a separate written agreement says otherwise. We may modify, limit, or discontinue a feature to improve the Service, address security or legal requirements, respond to a provider change, or manage capacity.

We will not present an unavailable public API, GA SDK, CLI, or other future feature as currently available. Where practical, we will provide reasonable notice before a change materially reduces paid access.

You may stop using Cuna at any time and may request account deletion at angel@getcuna.com or contact@getcuna.com.

We may limit or suspend access when reasonably needed to address a security risk, suspected unlawful activity, violation of these Terms, provider restriction, nonpayment under a separate order, or risk to Cuna or another user. Where practical and lawful, we will provide notice and an opportunity to correct the issue. We may terminate an account for a material or repeated violation.

Following termination, information is retained or deleted under the Privacy Policy and applicable law. Some records may remain for security, legal compliance, disputes, or provider backup cycles.

To the maximum extent permitted by law, the Service is provided as is and as available. Cuna disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Cuna does not warrant that the Service, machines, agents, records, or output will be uninterrupted, error-free, secure, complete, accurate, or suitable for a particular use. These disclaimers do not exclude a warranty or right that applicable law does not allow us to exclude.

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or lost profits, revenue, business, data, or goodwill, arising from the Service or these Terms, even if advised that the loss was possible.

Any aggregate limit is the limit permitted by applicable law and an applicable separate written order. No fixed contractual cap has been adopted for the current early-access Service.

Nothing in these Terms limits liability for fraud, willful misconduct, death or personal injury caused by negligence, or another liability that applicable law prohibits limiting.

If you use Cuna for a business or organization, that organization will defend and indemnify Cuna against third-party claims arising from Your Content, your mandates, unauthorized or unlawful use, or a material breach of these Terms, except to the extent the claim was caused by Cuna. This section does not apply to an individual acting as a consumer where applicable law does not permit it.

Cuna has not adopted a special arbitration, choice-of-law, or exclusive-forum clause for the current early-access Service. Applicable law and ordinary conflict-of-law rules determine the law and court with jurisdiction. Mandatory consumer protections and local forum rights continue to apply where they cannot be waived.

These Terms, the Privacy Policy, and an applicable order form or written agreement form the agreement concerning the Service. If a provision is unenforceable, the remainder stays in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; Cuna may assign them with a reorganization or transfer of the Service, subject to applicable law.

Nothing here creates a partnership, employment, fiduciary, franchise, or legal agency relationship.

We may update these Terms. We will post the revised version, change the effective date, and present material changes in the Service before relying on them. If law requires renewed consent, continued use alone will not replace that consent.
